1. INTRODUCTION

The Albanian-American Development Foundation (AADF), with its address at Rruga Ibrahim Rugova, Building 42, Entrance 7, Apartment 60, Tirana (hereinafter referred to as “AADF”, “we” or “our”), acting as the controller of personal data in connection with the LEAD Albania Program, is committed to respecting your privacy and complying with all applicable laws on personal data protection and privacy.

This Personal Data Protection Notice (the “Notice”) is intended to inform you about how we use the data you submit when you apply for the LEAD Albania Program through our website, as well as your personal data during and after the duration of the LEAD Albania Program.

2. PERSONAL DATA THAT WE COLLECT AND PROCESS

In connection with the LEAD Albania Program, we collect and process the following categories of personal data:

• Application data that you submit through our website when applying to participate in the LEAD Albania Program, including:
• Identification data: name, surname, personal identification number, date and place of birth, nationality;
• Contact data: email address, telephone number, social media account, where applicable, and residential address;
• Employment-related data: occupation, employer, position/title, period of employment, and contact details of your current employer;
• Referee personal data: name, email address, and telephone number of individuals providing references in support of your application;
• Education-related data: academic degrees/qualifications, educational institution(s), and period of study;
• Professional and personal development data: volunteer activities, other qualifications, language skills, and social skills and competencies;
• Host institution preferences: your preferences regarding the institution at which you would undertake the Program placement;
• Application materials: Essay and letter of motivation;
• Personality assessment data: results of personality assessments conducted as part of the application and selection process.

• Personal data of participants during the LEAD Albania Program:
• Identification data: name, surname, personal identification number, date and place of birth, nationality;
• Contact data: residential address, email address, telephone number, social media contact details, where applicable;
• Employment and training-related data: host institution, salary, performance, participation in training activities, leave, absences, and bank account details;
• Image and voice recordings.

• Personal data of LEAD Alumni members following completion of the LEAD Albania Program:
• Identification and contact data: name, surname, email address and telephone number;
• Program related data: host institution and LEAD Albania Program cohort, in which the member participated;
• Employment-related data: position/title and place of employment;
• Image and voice recordings.

This personal data will be processed only for the purposes specified in this Notice and always in compliance with applicable data protection laws and legal requirements.

3. PURPOSES OF THE COLLECTION AND PROCESSING OF PERSONAL DATA

We will process your personal data for the purposes of administering and managing the LEAD Albania Program, including:

• Managing the application and candidate selection process;
• Administering and implementing the LEAD Albania Program;
• Communicating about and promoting the LEAD Albania Program;
• Monitoring and evaluating the LEAD Albania Program;
• Establishing, maintaining and strengthening the LEAD Alumni network; and
• Complying with our legal and regulatory obligations and implementing our internal policies and procedures.

We will not collect, retain or otherwise process personal data that is not necessary for the purposes described above. Where we intend to process your personal data for a purpose that is not compatible with the purposes described in this Notice, we will provide you with appropriate information about such further processing and, where required by applicable law, the legal basis on which the processing is based.

You are not under a legal or contractual obligation to provide personal data as part of the application process. However, if you choose not to provide all of the personal data requested in our call for applications, please note that this may limit our ability to assess your application and may affect your eligibility for, or participation in, the LEAD Albania Program.

4. PERSONAL DATA PROCESSING ACTIVITIES

The processing activities we carry out for the purposes specified in this Notice include the following:

• Application and selection process
• Receiving, recording and reviewing your application and the supporting documentation submitted;
• Assessing and evaluating your application and the relevant documentation against the applicable selection criteria;
• Conducting interviews and assessments of candidates as part of the selection process;
• Verifying the information provided by you;
• Selecting participants for the LEAD Albania Program; and
• Communicating with you during and after the application and selection process, including in relation to the status and outcome of your application.

• Participation in the LEAD Albania Program
• Placement with the host institution, including the preparation and execution of employment-related documentation;
• Maintaining personnel records;
• Administering salary, benefits and other employment-related matters;
• Managing attendance and leave, and monitoring participation and performance;
• Administering training and other activities of the LEAD Albania Program;
• Administering work-related and Program-related travel and associated expenses; and
• Complying with legal obligations relating to employment, taxation, and social and health insurance.

• Establishment and engagement with the LEAD Alumni Network
• Establishing, maintaining and updating records of participants who have completed the LEAD Albania Program (LEAD Alumni);
• Sending invitations to events and other activities of the LEAD Alumni Network;
• Facilitating networking and engagement among LEAD Alumni; and
• Communicating opportunities, initiatives and other matters relevant to the LEAD Alumni community.

• Communication and promotion of the Program
• Taking and using photographs, videos and other audiovisual materials featuring Program participants;
• Publishing the participant’s name, surname, photograph, host institution and participant profile on the LEAD Albania website and social media channels;
• Publishing the LEAD Alumni members’ name, surname, host institution and cohort on the LEAD Albania website;
• Collecting testimonials, stories and other materials from LEAD Albania Program participants and LEAD Alumni;
• Publishing such materials on the AADF and LEAD Albania websites, social media channels, in reports and publications, and through other communication channels; and
• Communicating information about the LEAD Albania Program, its participants and alumni, Program activities and impact.

5. LEGAL BASES FOR PROCESSING

We rely on the following legal bases for the processing of your personal data:

• The necessity to perform a contract of employment entered into with you if you are selected for the LEAD Albania Program, and the tripartite agreement between you, AADF and the relevant host institution, or to take steps at your request prior to entering into such contractual arrangements, following your submission of an application to participate in the LEAD Albania Program;
• Compliance with legal or regulatory obligations applicable to the processing of your personal data;
• AADF’s legitimate interests in selecting the most suitable candidates to participate in the LEAD Albania Program, monitoring and evaluating the LEAD Albania Program, communicating information about and promoting the Program, and establishing and strengthening the LEAD Alumni Network; and
• Your explicit consent to the collection, use and dissemination of your first name, last name, image and/or voice in connection with activities carried out during or following the LEAD Albania Program and its promotion.

6. RETENTION OF APPLICATION DATA

Your personal data will be stored in your application file, in our human resources management systems or other information and communication technology (ICT) systems (including email), and in physical form.

7. OUR OBLIGATIONS

When processing your personal data, we ensure that such data:

• are collected only for the purposes specified above;
• are processed lawfully, fairly and transparently;
• are kept securely and only for as long as necessary to fulfil the relevant purpose for which they were collected; and
• are shared only with persons who need access to them for work-related purposes in connection with the LEAD Albania Program, subject to appropriate confidentiality obligations.

8. YOUR RIGHTS

Under applicable data protection laws, your rights in relation to your personal data include, but are not limited to, the following:

• The right to request access to and a copy of your personal data;
• The right to request the rectification or erasure of your personal data, including the right to be forgotten;
• The right to request receipt of your personal data in a structured, commonly used and machine-readable format and/or to request the transfer of your personal data to another controller;
• The right to object to or request restriction of the processing of your personal data;
• The right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects or similarly significant effects concerning you; and
• The right to withdraw your consent at any time, where the processing is based on your consent.

9. DATA SHARING

We will share your application data with the members of the committee involved in the selection process, who are required to sign a declaration of confidentiality.

If you are selected by the AADF selection committee, your personal data will be shared with the relevant host institution for the purpose of confirming your placement with that institution during the duration of the Program, in accordance with the agreement between AADF and the relevant host institutions.

The contact details of LEAD Alumni may be shared with members of the LEAD Alumni Advisory Committee, appointed by AADF, for the purpose of facilitating direct communication regarding initiatives, activities, opportunities and other matters relating to the LEAD Alumni community. Members of the Advisory Committee are required to sign a declaration of confidentiality.

AADF may engage other companies or organizations to provide certain services or organize certain elements of our activities on our behalf and for our account. Where such organizations process personal data in connection with their services to AADF, we consider them to be personal data processors. AADF enters into data processing agreements with such processors to ensure the confidentiality and appropriate handling of personal data. The provider of our LEAD Albania Program application system is an example of such a processor.

10. DATA RETENTION PERIOD

We will retain your personal data only for as long as necessary to fulfil the purposes for which it was collected, as specified in this Notice.

If your application is unsuccessful, your application data will be retained for five (5) years from the conclusion of the selection process.

If your application is successful, your application data will be transferred to your personnel file and retained for the duration of the LEAD Albania Program (one (1) year) and five (5) years from the date you complete the Program, except for the personal data of LEAD Alumni members.

The personal data of LEAD Alumni members will be retained for as long as they remain part of the LEAD Alumni community and, in any event, no longer than until their death or one (1) year following AADF’s decision to discontinue the LEAD Albania Program, whichever occurs earlier. This retention period reflects the fact that, following completion of the LEAD Albania Program, you remain a member of the LEAD Alumni community throughout your lifetime, provided that AADF continues to implement the LEAD Albania Program, unless you request the erasure of your personal data or another legal basis exists for retaining such data.

11. SECURITY MEASURES

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, misuse or destruction.

Ky Njoftim për Mbrojtjen e të Dhënave Personale (“Njoftimi“) synon t’ju informojë se si ne i përdorim të dhënat që dorëzoni kur aplikoni për Programin LEAD Albania nëpërmjet faqes sonë të internetit, si dhe të dhënat tuaja personale gjatë dhe pas kohëzgjatjes së Programit LEAD Albania.

2. TË DHËNAT PERSONALE QË MBLEDHIM DHE PËRPUNOJMË

Në kuadër të Programit LEAD Albania, ne mbledhim dhe përpunojmë kategoritë e mëposhtme të të dhënave personale:

• Të dhënat e aplikimit që ju dorëzoni përmes faqes sonë të internetit kur kërkoni të merrni pjesë në Programin LEAD Albania:
• Të dhëna identifikimi: emri, mbiemri, numri personal, data dhe vendi i lindjes, shtetësia;
• Të dhëna kontakti: adresa e email-it dhe numri i telefonit, llogari media sociale, nëse ka, adresa e banimit;
• Të dhëna rreth punësimit: profesioni, punëdhënësi, pozicioni/titulli, periudha e punësimit, të dhëna kontakti të punëdhënësit aktual,
• Të dhëna personale të rekomanduesit: emër, adresë email-i, numër telefoni të individëve që japin rekomandime në mbështetje të aplikimit tuaj;
• Të dhëna rreth edukimit: diploma/kualifikime akademike, institucioni arsimor, periudha e studimit;
• Të dhëna rreth zhvillimit profesional dhe personal: veprimtari vullnetare, kualifikime të tjera, aftësi gjuhësore, dhe aftësitë e kompetencat sociale;
• Preferencat e institucionit pritës: preferencat tuaja lidhur me institucionin pranë të cilit do të vendoseshit gjatë Programit;
• Materiale aplikimi: Eseja dhe letra e motivimit;
• Të dhëna rreth vlerësimit të personalitetit: rezultatet e vlerësimit të personaliteti që kryhet si pjesë e procesit të aplikimit dhe përzgjedhjes.

• Të dhënat personale të pjesëmarrësve gjatë Programit LEAD Albania:
• Të dhëna identifikimi: Emri, mbiemri, numri personal, data dhe vendi i lindjes, shtetësia;
• Të dhëna kontakti: adresa e banimit, adresa e email-it, numri i telefonit; adresa media sociale, nëse ka;
• Të dhëna rreth punësimit dhe trajnimeve: institucioni pritës, paga, performanca, pjesëmarrjen në trajnime, lejet, mungesat, të dhënat bankare.
• Regjistrime imazhi dhe zëri.

• Të dhënat personale të anëtarëve të LEAD Alumni pas përfundimit të Programit LEAD Albania:
• Të dhëna identifikimi dhe kontakti: Emri, mbiemri, , adresa e email-it dhe numri i telefonit;
• Të dhëna lidhur me Programin: institucioni pritës dhe kohorta e Programit LEAD Albania ku ka marrë pjesë anëtari;
• Të dhëna rreth punësimit: pozicioni/titulli dhe vendi i punës;
• Regjistrime imazhi dhe zëri.

Këto të dhëna personale do të përpunohen vetëm për qëllimet e përmendura në këtë Njoftim dhe gjithmonë në përputhje me legjislacionin e zbatueshëm për mbrojtjen e të dhënave personale dhe kërkesat ligjore.

3. QËLLIMI I MBLEDHJES DHE PËRPUNIMIT TË TË DHËNAVE PERSONALE

Të dhënat personale do të përdoren nga ne me qëllim administrimin dhe menaxhimin e Programit LEAD Albania, përfshirë:

• Menaxhimin e procesit të aplikimit dhe përzgjedhjes së kandidatëve;
• Administrimin dhe zbatimin e Programit LEAD Albania;
• Komunikimet dhe promovimin e Programit LEAD Albania;
• Monitorimin dhe vlerësimin e Programit LEAD Albania;
• Krijimin, mbajtjen dhe fuqizimin e rrjetit LEAD Alumni;
• Përmbushjen e detyrimeve tona ligjore, rregullatore dhe zbatimin e politikave dhe procedurave tona të brendshme.

Ne nuk do të mbledhim, ruajmë ose përpunojmë asnjë të dhënë personale që nuk është e nevojshme për të përmbushur qëllimet e mësipërme. Nëse synojmë të përpunojmë të dhënat tuaja personale për një qëllim tjetër që nuk përputhet me qëllimet e përcaktuara në këtë Njoftim, do t’ju ofrojmë informacionin e nevojshëm lidhur me këtë përpunim të mëtejshëm dhe, kur kërkohet nga legjislacioni në fuqi, do t’ju informojmë për bazën ligjore mbi të cilën mbështetet ky përpunim.

Ju nuk keni asnjë detyrim ligjor ose kontraktual për të dhënë të dhëna personale gjatë procesit të aplikimit. Megjithatë, nëse ju vendosni të mos jepni të gjitha të dhënat që kërkohen nga ne në thirrjen tonë për aplikim, ju lutem mbani në konsideratë se vlerësimi juaj si kandidat mund të jetë i kufizuar dhe mund të ndikojë në përzgjedhjen ose pjesëmarrjen tuaj në Programin LEAD Albania.

4. AKTIVITETET E PËRPUNIMIT TË TË DHËNAVE PERSONALE

Aktivitetet e përpunimit që kryejmë për qëllimet e caktuara në këtë Njoftim përfshijnë sa vijon:

• Procesi i aplikimit dhe përzgjedhjes
• Marrja, regjistrimi dhe rishikimi i aplikimit tuaj dhe dokumentacionit të dorëzuar;
• Vlerësimi i aplikimit tuaj dhe dokumentacionit përkatës kundrejt kritereve të përzgjedhjes;
• Kryerja e intervistave dhe vlerësimeve të kandidatëve gjatë procesit të përzgjedhjes;
• Verifikimi i informacionit të dhënë;
• Përzgjedhja e pjesëmarrësve të Programit LEAD Albania;
• Komunikimi me ju gjatë dhe pas procesit të aplikimit dhe përzgjedhjes, përfshirë në lidhje me statusin dhe rezultatin e aplikimit tuaj.

• Komunikimi dhe promovimi i Programit
• Marrja dhe përdorimi i fotografive, videove dhe materialeve të tjera audiovizuale ku paraqiten pjesëmarrës të Programit;
• Publikimin e emrit, mbiemrit, fotografisë, institucionit pritës dhe profilit të pjesëmarrësit në Program në faqen e internetit të LEAD Albania dhe në media sociale;
• Publikimi i emrit, mbiemrit, institucionit pritës dhe kohortës në të cilën ka marrë pjesë në Program për anëtarët e LEAD Alumni, në faqen e internetit të LEAD Albania;
• Marrja e dëshmive, historive dhe materialeve të tjera nga pjesëmarrësit e Programit LEAD Albania/LEAD Alumni;
• Publikimi i këtyre materialeve në faqen e internetit të AADF, LEAD Albania, në rrjetet sociale, raporte, publikime dhe kanale të tjera komunikimi;
• Komunikimi i informacionit lidhur me Programin LEAD Albania, pjesëmarrësit, alumni, aktivitetet dhe ndikimin e programit.

5. BAZAT LIGJORE TË PËRPUNIMIT

Ne mbështetemi në bazat e mëposhtme ligjore për përpunimin e të dhënave tuaja personale:

• Nevojën për përmbushjen e kontratës së punës që lidhet me ju nëse përzgjidheni në Programin LEAD Albania dhe marrëveshjes tre-palëshe ndërmjet jush, AADF dhe institucionit pritës përkatës, ose për marrjen e hapave që i paraprijnë lidhjes së këtyre marrëdhënieve kontraktore sipas kërkesës suaj përmes plotësimit dhe dorëzimit të aplikimit tuaj për të marrë pjesë në Programin LEAD Albania;
• Detyrimet ligjore ose rregullatore lidhur me përpunimin e të dhënave tuaja personale;
• Interesin e ligjshëm të AADF për përzgjedhjen e kandidatëve më të përshtatshëm për të marrë pjesë në Programin LEAD Albania, monitorimin dhe vlerësimin e Programit LEAD Albania, komunikimin e informacionit dhe promovimin e këtij Programi, si dhe krijimin dhe fuqizimin e Rrjetit LEAD Alumni; dhe
• Pëlqimin tuaj të shprehur për marrjen, përdorimin dhe shpërndarjen e emrit, mbiemrit, imazhit dhe/ose zërit tuaj në kuadër të aktiviteteve që kryhen gjatë apo pas Programit LEAD Albania dhe promovimit të tij.

6. RUAJTJA E TË DHËNAVE TË APLIKIMIT

Të dhënat tuaja personale do të ruhen në dosjen tuaj të aplikimit, në sistemet e menaxhimit të burimeve njerëzore ose sisteme të tjera TIK (përfshirë emailin) dhe në kopje fizike.

7. DETYRIMET TONA

Kur përpunojmë ndonjë nga të dhënat personale, ne sigurohemi që këto të dhëna:

• Mblidhen vetëm për qëllimet e parashikuara më sipër;
• Përdoren në mënyrë të ligjshme, të drejtë dhe transparente;
• Mbahen në mënyrë të sigurt dhe vetëm për aq kohë sa janë të nevojshme për përmbushjen e qëllimit përkatës për të cilin janë mbledhur;
• Ndahen vetëm me persona që kanë nevojë të kenë akses për qëllim të punës lidhur me Programin LEAD Albania, bazuar në kushte konfidencialiteti.

8. TË DREJTAT TUAJA

Sipas legjislacionit të zbatueshëm, të drejtat tuaja në lidhje me të dhënat tuaja personale janë por nuk kufizohen në sa më poshtë:

• Të kërkoni akses dhe kopje të të dhënave tuaja personale;
• Të kërkoni korrigjimin ose fshirjen e të dhënave tuaja personale, përfshirë të drejtën për t’u harruar;
• Të kërkoni marrjen e të dhënave tuaja personale në një format të strukturuar, të përdorur gjerësisht dhe të lexueshëm nga pajisjet dhe/ose transferimin e të dhënave tuaja personale te një kontrollues tjetër;
• Të kundërshtoni ose kufizoni përpunimin e të dhënave tuaja personale;
• Të mos jeni subjekt i një vendimi që bazohet vetëm në përpunimin automatik të të dhënave, përfshirë profilizimin, i cili shkakton pasoja ligjore ose pasoja të ngjashme të rënda mbi ju;
• Të revokoni pëlqimin tuaj në çdo kohë, nëse përpunimi mbështetet tek pëlqimi.

9. NDARJA E TË DHËNAVE

Ne do të ndajmë të dhënat tuaja të aplikimit me anëtarët e komisionit të përfshirë në procesin e përzgjedhjes, të cilët nënshkruajnë një deklaratë për ruajtjen e konfidencialitetit.

Nëse përzgjidheni fitues nga komisioni i AADF, të dhënat tuaja do të ndahen me institucionin pritës përkatës për konfirmimin e vendosjes suaj në këtë institucion gjatë kohëzgjatjes së Programit, në përputhje me marrëveshjen që AADF ka lidhur me institucionet pritëse përkatëse.

Të dhënat e kontaktit të LEAD Alumni mund të ndahen me anëtarët e Bordit Këshillimor të Rrjetit LEAD Alumni, të emëruar nga AADF, me qëllim lehtësimin e komunikimit të drejtpërdrejtë lidhur me iniciativa, aktivitete, mundësi dhe çështje të tjera që lidhen me komunitetin LEAD Alumni. Anëtarët e Bordit Këshillimor nënshkruajnë një deklaratë për ruajtjen e konfidencialitetit.

AADF mund të angazhojë shoqëri ose organizata të tjera për kryerjen e disa shërbimeve ose organizimin e disa elementeve të aktiviteteve tona në emër e për llogarinë tonë. Nëse këto organizata përpunojnë të dhëna personale në kuadër të punës së tyre për AADF, ne i konsiderojmë përpunues të dhënash personale. AADF lidh marrëveshje për përpunimin e të dhënave me këta përpunues për të siguruar konfidencialitetin dhe trajtimin e kujdesshëm të të dhënave personale. Furnitori i sistemit tonë të aplikimit për Programin LEAD Albania është një shembull i këtyre përpunuesve.

10. PERIUDHA E RUAJTJES SË TË DHËNAVE

Ne do t’i ruajmë të dhënat tuaja personale vetëm për aq kohë sa është e nevojshme për përmbushjen e qëllimeve për të cilat janë mbledhur, siç përcaktohen në këtë Njoftim.

Nëse aplikimi juaj është i pasuksesshëm, të dhënat e aplikimit do të ruhen për 5 (pesë) vite nga përfundimi i procesit të përzgjedhjes.

Nëse aplikimi juaj është i suksesshëm, të dhënat e aplikimit do të transferohen në dosjen tuaj personale dhe do të ruhen gjatë kohëzgjatjes së Programit LEAD Albania (1 (një) vit) dhe për 5 (pesë) vite nga përfundimi i Programit nga ana juaj, me përjashtim të të dhënave personale të anëtarëve të LEAD Alumni.

Të dhënat personale të anëtarëve të LEAD Alumni do të ruhen për aq kohë sa ata mbeten pjesë e komunitetit LEAD Alumni dhe, në çdo rast, jo më gjatë se deri në vdekjen e tyre ose një (1) vit pas vendimit të AADF për përfundimin e Programit LEAD Albania, cilado të ndodhë më herët. Kjo periudhë ruajtjeje lidhet me faktin se, pas përfundimit të Programit LEAD Albania, ju mbeteni pjesë e komunitetit LEAD Alumni gjatë gjithë jetës suaj, për sa kohë që AADF vazhdon implementimin e Programin LEAD Albania, përveç kur kërkoni fshirjen e të dhënave tuaja personale ose kur ekziston një bazë tjetër ligjore për ruajtjen e tyre.

Ne zbatojmë masa teknike dhe organizative të përshtatshme për të mbrojtur të dhënat tuaja personale nga aksesi i paautorizuara, humbja, keqpërdorimi ose shkatërrimi.
